TAKFIR

Takfir is the act of declaring a Muslim as a disbeliever. Ahlul Sunnah wal-Jamaa’ah do not determine any Muslim who commits an act of disbelief, a disbeliever, except after the establishment of proof by which such declaration becomes necessary.

Only pronounce the Muslim as a disbeliever if:

  1. he/ she denies the existence of Allah, or

  2. he/she denies the Prophethood of Muhammad – his message and him being the last messenger

DEFINITIONS OF DISBELIEF

  • Disbelief of Denial: deny the Messengers of Allah or to claim that the Messengers have come with other than the truth.

  • Disbelief of creed: disbelief that denies Faith and falsifies Islam

  • Disbelief of Refusal inspite of certainty: refuse to follow the truth from his Lord Allah (even though he believes it) due to arrogance

  • Disbelief of Avoidance: taking all means to avoid listening to the Messenger and knowing the truth

  • The Disbelief of hypocrisy: acted that he believed the Holy Prophet, while not truly believing it

  • Disbelief of doubt: not fully convinced or have doubts in respect of the Holy Prophet and hesitates to follow him or the Islamic law

MISINTERPRETATION

ISIS released a doctrine on takfir which is the practice of declaring a Muslim as a disbeliever or apostate. However, they do not have the authority to practice takfir or their reason of pronouncing someone as a disbeliever is incorrect as per the Qur’an.  Per the Qur’an, a Muslim will be apostate when he/she denies the existence of Allah and the Prophethood of Muhammad. (Refer to the examples below)

The 40-points doctrine can be summarised in:

  • The point begins with a warning against all types of extremism in takfir.

  • ISIS rejects the Murji`ite’s doctrines, a) al-irja’ (deferred judgment on faith) that views God as the sole authority to judge who is Muslim and who is not in the Afterlife, and b) Muslims should regard any person who is outwardly Muslim as part of the Muslim community even if he commits grave sin because sin has no adverse effect on salvation as long he remains faithful.

  • ISIS’ stand on takfir is based on the creed of the Sunni and guided by the tradition of noble Sunni scholars.

  • ISIS regards all who proclaim the Shahadah (Testimony of Faith) as Muslims, until proven otherwise.[8]

  • ISIS’ method of takfir on a specific person or organisation is premised on the following conditions
    – it must be based on clear and strong
evidences that are soundly established, not speculations
    – it must meet all the necessary requirements required by the
    shari`ah
    – it must be free from inhibitions recognised by theshari`ah
    – the person involved must be presented with the right argument and evidence first
    – it must be issued by ISIS’ authorised bodies.[9]

  • ISIS do not perform takfir on all Muslims today, or those who commit sins except if they regard them as halal (permissible),[10] or those who do not join ISIS, or those who differ, criticise or fight ISIS, or Muslims who live in non-Muslim countries.[11]

  • ISIS rules the following people as kafir (disbelievers)
    – a person who performs any of the ten nullifiers of faith[12]
    – all Twelver Shiites – both ordinary person and scholars[13]
    – those who reject the takfir of Twelver Shiite scholars (not the takfir on an ordinary person), as disbelievers
    – all parties based on communism, secularism, nationalism and liberalism;[14] proponents of democracy and those who participate in its process; all governments that do not rule by the
shari`ah and members of its military, police officers, intelligence, executive and judiciary apparatuses[15]
    – all those who seek to judge by civil laws[16]
    – those who mock and insult the Prophet and his noble family members[17]
    – all Baathists[18]
    – all leaders of Islamic Party of Iraq, not its ordinary members
    – all practitioners of sorcery.[19]

CORRECT INTERPRETATION

Ahlul Sunnah wal-Jamaa’ah do not declare a person as a disbeliever under the following circumstances:

1-He is compelled to commit an act of disbelief, but his heart is satisfied with faith.

2- Even if he has committed a major sin as long as it is less than shirk. Rather, it is said that his faith is defective and committed a major sin. Allah (S.W.T) says in Surah Al Nisa verse 48

Meaning: Indeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He wills. And he who associates others with Allah has certainly fabricated a tremendous sin.

Allah (S.W.T) also says in Surah Az-Zumar verse 53:

قُلْ يَا عِبَادِيَ الَّذِينَ أَسْرَفُوا عَلَىٰ أَنفُسِهِمْ لَا تَقْنَطُوا مِن رَّحْمَةِ اللَّهِ ۚ إِنَّ اللَّهَ يَغْفِرُ الذُّنُوبَ جَمِيعًا ۚ إِنَّهُ هُوَ الْغَفُورُ الرَّحِيمُ

Say, "O My servants who have transgressed against themselves [by sinning], do not despair of the mercy of Allah . Indeed, Allah forgives all sins. Indeed, it is He who is the Forgiving, the Merciful."

3- Committing a sin that is not written in the Qur’aan and Sunnah as constituting disbelief. The false sects declare Muslim as disbeliever when he committed major sins or as lying between two positions.

Allah's messenger (S.A.W) said [Sahih Bukhari 5753]:

أَيُّمَا امْرِئٍ قَالَ لِأَخِيهِ يَا كَافِرُ فَقَدْ بَاءَ بِهَا أَحَدُهُمَا إِنْ كَانَ كَمَا قَالَ وَإِلَّا رَجَعَتْ عَلَيْهِ

Meaning: When a person calls his brother (in Islam) a disbeliever, one of them will certainly deserve the title. If the addressee is so as he has asserted, the disbelief of the man is confirmed, but if it is untrue, then it will revert to him.

He (S.A.W) also said [Sahih Muslim, Book of Faith 61]:

من دعا رجلا بالكفر، أو قال‏:‏ عدو الله، وليس كذلك إلا حار عليه

Meaning: If somebody accuses another of disbelief or calls him the enemy of Allah, such an accusation will revert to him (the accuser) if the accused is innocent.

He (S.A.W) also said [Sahih Bukhari 5752]:

لَا يَرْمِي رَجُلٌ رَجُلًا بِالْفُسُوقِ وَلَا يَرْمِيهِ بِالْكُفْرِ إِلَّا ارْتَدَّتْ عَلَيْهِ إِنْ لَمْ يَكُنْ صَاحِبُهُ كَذَلِكَ

Meaning: If somebody accuses another of disbelief or calls him the enemy of Allah, such an accusation will revert to him (the accuser) if the accused is innocent.

4- They will not declare anyone a disbeliever until the conditions of disbelieve have been established and all deterrents removed. Allah will be the one to decide to punish or pardon him who commits a sin.

Allah's Messenger (S.A.W) said in a hadith narrated by Abu  Huraira (R.A.) [Sunan Abu Dawud]:

Narrated Abu Huraira (R.A.):  I heard Allah's Messenger (S.A.W) saying: There were two fraternal persons among the children of Israel.  One of them was engrossed in committing sins while the other was devoted to worship.  The devotee used to see his fellow committing sin  and advise him:  Desist from doing so.  one day when he found his fellow committing sin.  H said to him:  Avoid it.  his fellow said:  Leave me alone.  have you been sent out as a vigilant on me.  The devotee said:   By Allah, he will neither forgive you nor admit you to paradise.  When they died, they were gathered before the Lord of the worlds. Allah asked the devotee:  Were you assured of knowing me or were you having power over what was in My Hands?  The He said to the sinner:  Go and enter Paradise by My Mercy; and ordered the angels about the devotee:  Lead him to Hell.

(This Hadith is sound and reported by Abu Da'ud in his Sunan).

After narrating the Hadith, Abu Huraira commented:  By Him in Whose Hand my soul is:  One word spoken by the devotee ruined his good deeds in the world as well as the Hereafter.
